These General Terms of Service, together with any additional terms and policies referenced herein (collectively, the "Terms" or "Agreement"), form the entire legal agreement between you ("Client") and TheOnionHost ("we", "us", "our") in relation to your use of our website and services including Shared Hosting, VPS Hosting, Dedicated Hosting, and Domain Registration.
By accessing, ordering, or using any of our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
Definitions
- "TheOnionHost", "we", "us", "our" โ the owner and operator of the website and Services.
- "Website" โ https://theonionhost.com, its subdomains, and any additional domains operated by TheOnionHost.
- "Visitor" โ any person or automated system browsing the Website without being a registered Client.
- "Client" โ any person or entity that has created an account and purchased or is using any of our Services.
- "Services" โ any hosting, infrastructure, domain, or related functionality provided by TheOnionHost.
- "Content" โ any data, text, images, audio, video, software, files, scripts, or other information stored or transmitted through the Services.
- "Managed Services" โ Services where TheOnionHost provides server maintenance, updates, and security configurations.
- "Unmanaged Services" โ Services where the Client is fully responsible for server setup, configuration, maintenance, and security.
- "AUP" โ Acceptable Use Policy, the rules governing permitted and prohibited uses of the Services.
- "Order" โ a service order or subscription placed via the Website or any authorized channel.
- "Billing Term" โ the payment period applicable to a Service (e.g., monthly, quarterly, annual).
Account Eligibility
2.1 Age Requirement
All Services are intended for users who are at least 18 years old. By purchasing or using any Service, you represent that you are at least 18 years of age and have full legal capacity to enter into this Agreement.
2.2 Authority to Bind an Entity
If you use the Services on behalf of a legal entity, you represent and warrant that you are authorized to bind that entity to these Terms. If we determine you do not have such authority, you will be personally liable for all obligations under this Agreement.
2.3 Accurate Information
You agree to provide accurate, current, and complete information when creating an account, placing an Order, and during your use of the Services, including valid contact and billing details.
Acceptance of Terms
By accessing the Website, creating an account, placing an Order, or using any of our Services, you confirm that you have read, understood, and agreed to these Terms in full, and agree to comply with all applicable laws and regulations regarding your use of the Services.
Any violation of these Terms or the AUP may result in warnings, temporary suspension, permanent termination, removal of data, and/or refusal of refunds.
Acceptable Use Policy
4.1 General
TheOnionHost provides Internet-related Services. While we support the open nature of the Internet, we protect our network and infrastructure, our reputation, and the integrity and security of our Clients and third parties. This AUP is an integral part of this Agreement.
4.2 Prohibited Content and Activities
You shall not use TheOnionHost Services for any of the following:
- โSpam / Unsolicited Communications โ sending unsolicited emails, SMS, or messages; running mailing lists without proper opt-in mechanisms; causing IP blacklistings.
- โDDoS / Network Attacks โ launching DDoS attacks, SYN floods, IP spoofing, port scans, or activities that degrade or disrupt network operation.
- โHacking / Exploits โ unauthorized access to systems; distributing malware, botnets, RATs, ransomware, keyloggers, or similar tools.
- โFraud / Phishing โ hosting phishing pages, fake login portals; carding, identity theft, fraud schemes, fake shops, money laundering.
- โBetting / Gambling โ hosting, promoting, or facilitating online betting, casinos, or gambling, even if legal in some jurisdictions.
- โAdult Content โ hosting any form of adult content, sexually explicit material, or pornography regardless of jurisdiction; any content involving exploitation or harm to minors.
- โMovie / Video Hosting on Shared Plans โ storing or distributing large video files (movies, TV series) on Shared Hosting plans. Allowed on VPS or Dedicated only.
- โIllegal Drugs / Medicines โ content promoting, selling, or distributing illegal drugs or unlicensed medicines.
- โMalware / Malicious Code โ hosting or distributing viruses, worms, Trojans, rootkits, coin miners without consent, or any other malware.
- โTor Exit Relays โ operating Tor exit nodes, open proxies, or anonymizing services without proper controls that can be abused for malicious activity.
- โIP Blacklisting โ any behavior causing our IP space to be blacklisted on RBLs or similar systems.
- โIP Infringement โ hosting, distributing, or linking to copyrighted material without proper authorization.
- โOther Illegal Activities โ activities criminal under applicable local or international laws; harassment, defamation, threats, or incitement to violence.
4.3 Resource Usage Limits
Shared Hosting: Excessive CPU, RAM, I/O, or bandwidth usage that negatively impacts other users is not permitted. We may throttle or suspend accounts with consistently abusive usage.
VPS Hosting: Sustained use of 90% or more of allocated CPU or disk I/O may be considered abusive. We may require optimization or impose limits.
Dedicated Servers: You have broad control over hardware resources but may not jeopardize TheOnionHost's network or other clients. Activities causing network instability or legal risks may result in suspension.
Privacy & Data
TheOnionHost collects and uses your personal information solely for the purpose of providing the Services. We do not sell, rent, or share your personal information with third parties, except where required by law or for fulfilling service obligations.
You are fully responsible for all activity on your account, regardless of whether such activity was authorized by you. You must take reasonable precautions to prevent unauthorized access to your account.

Billing & Payments
All services are billed in advance for the agreed Billing Term. Invoices are due on the date specified. Failure to pay by the due date may result in service suspension or termination.
We accept credit/debit cards, PayPal, Bitcoin, Monero, Ethereum, USDT, Litecoin, and wire transfer. Cryptocurrency payments are non-refundable to external wallets once applied to an invoice.
Refunds are governed by our Refund Policy. Dedicated servers are strictly non-refundable. Shared and VPS plans carry a 7-day money-back guarantee for card/PayPal payments only.
Service Availability
TheOnionHost targets 99.9% network uptime for all services. We do not guarantee uninterrupted or error-free service. Scheduled maintenance will be announced in advance where possible.
We are not liable for downtime caused by circumstances beyond our reasonable control, including datacenter power outages, upstream network failures, DDoS attacks exceeding our mitigation capacity, or force majeure events.
Suspension & Termination
We reserve the right to suspend or terminate any Service immediately and without prior notice if we determine, in our reasonable judgment, that:
- You have violated these Terms or the AUP;
- Your account is involved in illegal activity;
- Your use poses a legal, reputational, or operational risk to TheOnionHost;
- Payment is overdue by more than 7 days after the due date.
Upon termination for AUP violation, no refunds will be issued. Upon voluntary cancellation, refunds are subject to our Refund Policy.
Limitation of Liability
To the maximum extent permitted by applicable law, TheOnionHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Services.
Our total liability under this Agreement shall not exceed the amount paid by you for the Services in the three months immediately preceding the event giving rise to the claim.
Governing Law
These Terms are governed by the laws of the jurisdiction in which TheOnionHost is registered. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
For services hosted in specific jurisdictions (Bulgaria, Ukraine, Netherlands), the laws of the respective hosting jurisdiction apply with respect to Content and infrastructure disputes.
Amendments
TheOnionHost reserves the right to revise these Terms at any time. Changes will be published on our website and will take effect immediately upon publication. It is your responsibility to review these Terms periodically. Continued use of the Services after changes constitutes acceptance of the revised Terms.
