These Terms of Service (“TOS”) govern your use of all services provided by TheOnionHost, including but not limited to Shared Hosting, VPS Hosting, Dedicated Hosting, and Domain Registration (collectively referred to as “Services”). 2. Acceptance of Terms

Using TheOnionHost Services, you acknowledge that you have read, understood, and agree to these TOS. Violating these terms may result in suspending or terminating your account and forfeiting any rights under our refund policy.

3. Acceptable Use Policy (AUP)

3.1. General Information

TheOnionHost provides Internet-related services, including web hosting, VPS hosting, and dedicated servers. While we respect the open nature of the Internet, we reserve the right to take preventative or corrective actions to protect our network, customers, and reputation.

This AUP outlines acceptable and prohibited uses of our Services. It supplements and explains the terms of your service agreement and serves as a guide to your rights and obligations. The AUP may be revised periodically, and your continued use of the Services after changes are posted constitutes acceptance of the updated terms.

3.2. Scope

This AUP applies to all customers and users of TheOnionHost Services. It is incorporated by reference into all service agreements and governs the use of our products and services. TheOnionHost may modify this AUP at any time without prior notice.

3.3. Prohibited Activities

The following activities are strictly prohibited:

  • Spam: Sending unsolicited emails or messages.
  • DDoS/Attacks: Engaging in Distributed Denial of Service (DDoS) attacks, SYN floods, IP spoofing, or IP header modification.
  • Hacking: Unauthorized access to systems, networks, or data (e.g., botnets, RATs, ransomware).
  • Fraud/Phishing: Engaging in fraudulent activities, scams, phishing, or carding.
  • Illegal Content: Hosting or distributing pornography of any type.
  • Malware: Distributing viruses, worms, Trojans, or other malicious software.
  • Tor Exit Relays: Operating Tor exit nodes.
  • Blacklist Activities: Any activity that may result in IP blacklisting (e.g., SpamHaus, SpamCop).

3.4. Resource Usage

  • Shared Hosting: Excessive resource usage (e.g., CPU, RAM, bandwidth) that negatively impacts other users is prohibited. Customers may be required to upgrade to VPS or Dedicated Servers.
  • VPS Hosting: Using 90% or more of VPS resources for extended periods may result in suspension.
  • Dedicated Servers: While dedicated servers offer more flexibility, activities that harm our network or other users are prohibited.

3.5. Violations and Remedies

TheOnionHost reserves the right to take the following actions in response to violations:

  • Issue a warning to the customer.
  • Suspend or terminate the offending account.
  • Impose fees or charges as outlined in the service agreement.
  • Cooperate with legal authorities in cases of illegal activity.

No refunds will be provided for accounts terminated due to AUP violations.

4. Data Responsibility

You are solely responsible for maintaining regular backups of your data. TheOnionHost shall not be held liable for any data loss, regardless of the cause.

5. Managed vs. Unmanaged Services

TheOnionHost offers both Managed and Unmanaged services:

  • Managed Services: We handle all technical aspects, including server maintenance, updates, and security.
  • Unmanaged Services: Customers have full control over their hosting environment and are responsible for all technical management.

By purchasing our Services, you agree to adhere to the rules and responsibilities associated with your chosen service type.

6. Reservation of Rights

TheOnionHost reserves the right to:

  • Monitor communications to prevent violations of this AUP.
  • Suspend or terminate services without prior notice for AUP violations.
  • Modify or update these terms at any time.

7. Governing Law

These TOS shall be governed by and construed by the laws of Bulgaria. Any disputes arising from these terms shall be resolved exclusively in the courts of Bulgaria.
